Can I influence the effects of the donation on the succession?
If the gift was made to a forced heir, there is no time limit for taking it into account; if the gift was made to a person who is not entitled to a reserved share, it will only be taken into account if made during the last two years (see § 785 ABGB). A gift to a forced heir is taken into account during an unlimited period of time, both when settling the succession proceedings and in calculating the reserved share.
