Can I help one of my children without this reducing his/her share in the inheritance?
Yes, if it falls within the “disposable share”. Bulgarian inheritance law limits a person's right when it comes to leaving their assets without consideration. The law provides for part of the succession to be set aside for a given category of heirs to guarantee their survival and to assist future generations, based on a moral obligation and the family code. The disposable share of the estate is that part which can be disposed of free of consideration without affecting the reserved shares and without the heirs entitled to reserved shares being able to challenge the transaction. The disposable share depends on the number of heirs. Article 29 of the Inheritance Act provides for the size of the reserved share to be the ideal share of the assets, e.g. when there is a spouse and two children, the disposable share of the succession is ¼ and when there is a spouse and three children the disposable share is 1/6 of the succession. This means that, if one disposes of one's assets within these limits, the share of the succession falling to the child that has been helped, will not be decreased.
