An Agreement on Cession and Distribution of Property during Lifetime is valid if all descendants who would otherwise be intestate heirs are included. In entering an agreement, the descendant’s freedom of disposition represents a safety mechanism.
The Croatian Inheritance Act protects certain intestate heirs by granting them a right to a reserved portion.
In cases of donations or a will, the Croatian Inheritance Act provides a right for heirs belonging to the first rank of heirs (descendants and spouse) to claim the reserved portion. If the reserved portion was subject to dispositions through a will or donation, the law grants the heirs a right to claim a lesser amount of the mentioned transactions.
