Can I give my assets directly to my grandchildren?
Grandchildren may be parties to a donation agreement like any other person, according to the provisions of general obligation law. Their position changes depending on their right to a reserved portion. The law grants grandchildren a right to a reserved portion if they are intestate heirs.
A testator may bequeath a part of his/her assets to his/her grandchildren. In doing so, he/she might want to take into consideration the rights of other heirs in order to avoid claims of those heirs for protection of their right to a reserved portion.
