Can I influence the effects of the donation on the succession ?
It is provided by law that if a gift is of such magnitude that it deprives forced heirs of their preferential shares, then, when the succession opens, the forced heirs may demand to receive such shares.
It is provided by law that an heir shall add to the entirety of the property of the estate prior to its division all assets which the heir received from the donor while the latter was still alive. However, the duty to add shall not apply if the testator in a will has definitely prohibited such addition.
