How can I protect my spouse or partner?

It is possible to nominate your spouse or civil union partner as your sole ordinary heir which would mean that he/she would inherit the entirety of your estate. If your children decide to claim the reserved portion due to them, the surviving spouse or civil union partner will have to satisfy their claim, however he/she will be entitled to the rest of the estate, thus giving them a high level of protection under Maltese Law. The spouse and civil union partner is also protected at law since they are entitled to a reserved portion of the estate of their spouse/civil union partner over and above the right of habitation over the matrimonial home.
