Can my children renounce the inheritance in advance?

No. Under Maltese Law, no one may enter into agreements to renounce an inheritance in advance. However, your heirs may do so as soon as you pass away. It is important for those heirs who want to renounce the inheritance of a deceased that they do not in any way take any property of the deceased which will signify an acceptance of the inheritance. Compliance with fiscal obligations on successions, like declarations of transmission by cause of death, are not considered as an acceptance of inheritance.
