Slovenian legislation allows the drawing up of ‘agreements as to succession’ which are used by the testator to pass on property to the descendants or other persons and where the testator reserves specific rights (e.g. lifetime free-of-charge use of his/her flat or any other real estate, harvesting products e.g. from the field or orchard, care, assistance in the event of illness and old age - also with the help of a third party, making additional payments for care in homes for the elderly). It is, however, not necessary to pass on all assets to a third person, instead, one can keep certain real estate for oneself.
According to Slovenian law, such agreements must to drawn up in the form of a notarial record. Therefore, we recommend you to consult a notary who will advise you on such agreements.
