Can I influence the effects of the donation on the succession ?
The portion of the intestate heir includes any gift he/she has received at any time from the deceased. However, the gift is not included if the deceased declared at the time of making gift or later or in his/her will that the gift is not to be included in the inheritance portion or, if the circumstances allow the assumption, that this non-inclusion of the gift was the will of the deceased. However, any limitation in regard to the statutory share remains in full value.
